'FOP KOLOVANOVA HANNA YURIIVNA', 'KAWAI 2021' is a legal entity registered in accordance with the current legislation of Ukraine, which sells goods remotely (using the Internet store on the website shibuyasushikioskvv111-133.choiceqr.com).
Ordering goods remotely using the online store shibuyasushikioskvv111-133.choiceqr.com allows users of the specified Site (real and/or potential buyers) to find a description of the required product (including its technical characteristics, price, current promotions, address, conditions of sale, as well as other information that is mandatory for the remote form of sale of goods) and is guaranteed to purchase the selected product from the seller of the FOP KOLOVANOVA HANNA YURIIVNA, "KAWAI 2021".
This agreement regulates the relationship between the FOP KOLOVANOVA HANNA YURIIVNA, "KAWAI 2021" on the Internet, located at the address shibuyasushikioskvv111-133.choiceqr.com, and any user of the specified site - a natural or legal person who acts as a visitor to the site or a buyer from the Seller of goods posted on the site.
Basic concepts used in the User Agreement:

The Service is a set of services provided to the user for the use of the Site for informational purposes, for obtaining Content, as well as for the purpose of familiarization with the Goods.
The goods are bakery products, fruits and vegetables, confectionery, wine and vodka, non-alcoholic drinks, dairy and oil products, meat and sausage products, fish, egg, edible fats, tobacco products.

The user is a legally competent natural person who accepts the terms of this Agreement and has gone through the registration procedure on the Site in his own interest or acts on behalf and in the interests of a legal entity represented by him.
Buyer - the User who placed an Order on the Site for the purchase of the Goods specified on the Site and available at the Seller.
User registration on the Site is the process of creating the User's own Account by filling out special forms on the Site. Registration on the Site enables the registered user to receive the Site Service, place an Order for the purchase of Goods from the Seller electronically using the Site.
The User's account is a set of information about the user in accordance with the fields proposed by the Seller before filling in the fields on the Site, which allows to uniquely identify the user during his use of the Site. The account is created independently by the User by providing information about himself. To gain access to his account, the User uses the e-mail address and password provided to him during registration.
Order - a duly executed request of the Buyer for the purchase of Goods selected on the Site and available from the Seller, as well as for their delivery to the address specified by the Buyer under the conditions specified on the Site in the "Payment and Delivery" section.
1. Subject of the user agreement
1.1 The subject of this agreement is to provide the user with the opportunity to receive the Services of the Site, to receive the Content of the Site, as well as to purchase for personal, family, home and other needs, as well as for the needs related to the implementation of business activities, the Goods presented in the catalog of the Site at the address https://shibuyasushikioskvv111-133.choiceqr.com, as well as any development and/or addition of new services, Goods and services.1.2 This agreement applies to all Services, Goods, services presented on the Site.
1.3. A mandatory condition for using the Website and its Services is the user's full and unconditional acceptance of the terms of the following documents:

1.4 In case of disagreement with this user agreement (hereinafter - the Agreement), the User is obliged to stop using the Site and its Services and leave the Site.
1.5 With the help of the Site Services, the Seller provides users with:
information services through the publication of goods sold by the Seller itself through the Internet resource https://shibuyasushikioskvv111-133.choiceqr.com, namely: photos of the goods, their cost, availability or absence in the Seller's warehouse, current promotions for the product or a group of products , terms of ordering goods and their delivery, contact and other necessary information about the goods and about the Seller;
services for the purchase of goods, information about which is presented on the website https://shibuyasushikioskvv111-133.choiceqr.com and available, namely: the ability to order the selected product directly on the website, as well as by the specified phone number orally to the Seller's dispatcher; to receive the ordered goods (goods) within the terms agreed with the Seller at the address specified by the Buyer with a set of accompanying documents provided for by the current legislation of Ukraine.
1.6 The user expressly agrees that he uses the Site and any information posted on the site at his own risk.
1.7 The terms of this User Agreement are accepted by the User during registration in the manner prescribed by the Site and this User Agreement, as well as in the case of ordering the Goods from the Seller in any possible way.
1.8 The user agreement is valid for the entire time the User uses the Site Services and/or the entire time the Buyer orders Goods from the Seller.
1.9 The User Agreement may be changed by the Seller at any time and without any prior notice to the User. The new version of the User Agreement enters into force from the moment it is posted on the Site, unless otherwise provided by the new edition of the User Agreement.

2. Registration on the Site
2.1 Registration on the Site is mandatory for placing an Order. When placing an order by phone, the user also registers on the Site with the help of an employee of the Seller. At the same time, an Account on the Site is also created for the user. Creating a User Account from the User's words also constitutes acceptance of this User Agreement in its entirety and without any exclusions or limitations.
2.2 During registration, the user undertakes to provide only reliable, accurate and complete information about himself on the issues proposed in the registration form and to keep this information up to date. If the user provides incorrect information or the Seller has reason to believe that the information provided by the user is incomplete or unreliable, the Seller has the right at its sole discretion to block or delete the User's account, as well as deny the user the use of the Sites and its Services in whole or in part.
2.3 When registering on the Site, the User provides the following information: surname, first name, e-mail address, contact phone number.
2.4 User information contained in the User's account is stored and processed by the Seller in accordance with the Privacy Policy. The privacy policy is an integral part of the user agreement and is listed on the site
2.5 The User undertakes to immediately notify the Seller of any case of unauthorized use of his Account, as well as of known cases of compromise (loss of confidentiality) of the password used by the User to access his Account. Until the time when the Seller receives a notification from the User about the unauthorized use of his Account, or about the compromise of the password, the responsibility for all actions carried out using the relevant Account shall be borne by the User.
2.6 The user undertakes not to transfer you to other persons your personal data obtained during registration (login and password) for entering/identifying on the Site, and bear full responsibility for the loss, disappearance or transmission of personal data by other means, as well as for the consequences associated with this action. The seller is not responsible for the actions of third parties who used the user's personal data.
3. Terms of placing an Order and sale of Goods
3.1 By ordering the Goods in any way, the User agrees to the terms of placing the Order and selling the Goods established by the Seller.3.2 Terms of sale of Goods, as well as information about the Goods presented on the Site, is a public offer.
3.3 The User agrees to the terms of placing an Order and selling Goods by ticking the box "I agree with these terms" when registering on the Site and placing an Order.
ATTENTION: The Buyer bears full responsibility for providing incorrect information when placing the Order, which resulted in the inability of the Seller to properly fulfill its obligations to the Buyer.
3.4 In most cases, each unit of the Product presented on the Site is accompanied by a photograph. The photos accompanying the Product are simple illustrations of the Product and may differ from the actual appearance of the Product.

3.6 In the vast majority of cases, each unit of the Product presented on the Site is available from the Seller. In the event that the Buyer orders a Product that is not in the Seller's stock at the time the Order is executed, the Seller has the right to exclude the specified Product from the Order and/or cancel the Buyer's Order by notifying the Buyer of this by sending an appropriate electronic message to the address specified by the Buyer during registration, or by calling the Seller .
3.7 In the case of cancellation of a fully or partially prepaid Order, the price of the canceled Goods is returned by the Seller to the Buyer in a form that is additionally agreed by phone or e-mail.
3.8 The Seller takes all possible legal measures to secure in its warehouse all the Goods presented on the Site.
4. Delivery of the Order
4.1 Methods and prices for the delivery of the Goods are indicated on the Site on the delivery order page4.2 Delivery is a separate service of the Seller. Delivery is not an integral part of the Goods purchased by the Buyer.
4.3 The territory of delivery of the Goods presented on the Site is limited to the borders of Ukraine.
5. Price of the Product and terms of payment of the Order
5.1 All payments between the Parties are made in hryvnias.5.2 The price of the Product is indicated on the Site.
5.3 The price of the Goods presented on the Site can be changed unilaterally by the Seller. At the same time, the price of the Goods ordered by the Buyer cannot be changed.
5.4 The Seller may set a discount on individual (or all) names of the Goods (a promotion valid at the time of the Buyer's Order of these names of the Goods). The price of the Product with a discount is indicated on the website.
5.5 The Buyer pays for the Order by choosing one of the payment methods specified on the Site at his own discretion and possibilities
6. Return of Goods and funds
6.1 The return of goods is carried out in accordance with the Law of Ukraine "On the Protection of Consumer Rights". In a period of 14 days, excluding the day of purchase, you can return the product under the following conditions:- the product was not in use
- the integrity of the set and packaging is not violated
- a saved document confirming payment
- the product does not belong to the list of goods of inadequate quality, the return of which is limited by the decision of the Cabinet of Ministers of Ukraine (Decision of March 19, 1994 No. 172)
6.2 Refunds are made by returning the cost of the paid Goods to a bank card, postal transfer or cash at the company's office at the address indicated on the Site in the "Contacts" section. The method of refund is determined by the Buyer with the Seller by phone or e-mail.
7. Limitation of the Seller's liability
7.1 The seller is responsible to users for the content and security of the information posted on the site, for the reliability and relevance of information about goods, availability, prices, delivery conditions and other related services presented on the Site. At the same time, the Seller has the right, at his own discretion, to make changes to the descriptions of goods and services in order to best promote the goods on the market.7.2 The seller is not responsible for:
- for the consequences of application, use or non-use of information received on the site.
- for the possible inconsistency of the results obtained when using the site with the user's expectations.
- for any damage to the user's equipment or software that occurred as a result of using the site.
- for the inability to use the site for any reason.
7.3 The Seller is not liable to the User or third parties for damage, losses or expenses incurred in connection with the use or non-use of the site, including lost profit or unearned profit.
7.4 The User agrees that any information and images posted on the site may be used by the Seller at its sole discretion without payment of any remuneration to the User.
7.5 The Seller has no obligation to ensure the confidentiality of the information provided to its users. The Seller is not responsible for the discrepancy between the User's expectations and the actually received services/purchased goods.
8. Restrictions on the use of the site by the User
8.1 When using the site, the User does not have the right (and agrees to this):- copy and use for commercial purposes any information obtained with the help of this site, which violates the rights of other users or may cause them direct material or moral damage
- send unauthorized advertising-type mail messages (junk mail, spam) to the e-mail addresses indicated on the Resource
- pretending to be another person or a representative of the Seller without sufficient rights to do so, including the Seller's employees and the site owner.
8.2 The user agrees not to reproduce, duplicate or copy, sell or resell, and not to use for any commercial purpose any part of the site, use of the services or access to them, except when such permission is granted to the user Seller.

9. Rights and obligations of the user
9.1 The user is hereby informed and agrees that the responsibility for the delivery of the goods in the case of the User's agreement with the delivery and indication by the User of a valid address for the delivery of the Goods, as well as in the case of ensuring that the User accepts the Goods and pays for them, is borne by the Seller. All conflict situations and disputes related to the delivery of goods must be resolved by the user-buyer with the Seller.9.2 The User (including the buyer) is obliged to provide the Seller with information on all cases of conflict situations related to the sale of the Goods or the delivery of the Goods.
9.3 Any user has the right to leave feedback about the Products posted on the site.
9.4 The User undertakes not to take actions aimed at causing damage to the software or hardware part of the site (spread of virus programs, hacking of servers, etc.), as well as to notify the Seller of any known situations that pose a potential threat to the safe functioning of the Site. The user undertakes to strictly comply with the terms of this agreement and any additions to it.
10. Rights and obligations of the Seller.
10.1 The seller guarantees the confidentiality of user data.10.2 The Seller reserves the right to terminate access to the personal account and block and/or cancel registration without prior notice to the User, and bears no responsibility for termination of access to its services. In this case, the user's information is destroyed, and the user's registration is canceled.
10.3 In case the User violates the terms of this agreement, the Seller has the right to suspend cooperation and/or use of the site by this user until the violations committed by the User are eliminated and compensation (compensation) caused to the Seller by such violation in full.
10.4 The seller independently determines the term of publication of user reviews.
10.5 The seller does not notify users about the removal or refusal to publish reviews. The Seller has the right not to publish the User's withdrawal due to inconsistency with the real experience of using the Seller's services and the Seller's goods, or if the information is not useful for other Users of the site.
10.6 The Seller has the right to temporarily suspend the operation of the site for technical, technological or other reasons - during the elimination of such reasons with or without prior notice to the Buyers.
10.7 The Seller has the right to assign or in any other way transfer his rights and obligations arising from his relationship with the Buyer to third parties.
11. Responsibility of the user and the Seller
11.1 The Seller is not responsible for damage caused to the Buyer as a result of improper use of the Goods purchased from the Buyer using the Site services.11.2 The seller is not responsible for the information provided by the user on the Site in a publicly available form.
11.3 The user agrees that all possible disputes regarding this agreement shall be resolved in accordance with Ukrainian legislation. The user agrees that all possible disputes regarding his activities on the site will also be resolved according to the norms of Ukrainian legislation.
11.4 The seller does not establish agency relations, partnership relations, joint activity relations, personal employment relations, or any other relations with the user.
11.5 Inaction on the part of the Seller in case of violation by a user or group of users of this user agreement does not mean that the Seller facilitates the user or group of users in such actions.
11.6 The parties are released from responsibility for violation of the terms of this User Agreement, if such violation is caused by force majeure (force majeure), including: actions of state authorities (including the adoption of legal acts), fire, flood, earthquake, other natural disasters, lack of electricity and/or computer network failures, strikes, civil disturbances, riots, any other circumstances, not limited to the listed ones, which may affect the fulfillment of the Parties' obligations.
12. Final provisions
12.1 The provisions of the current legislation of Ukraine apply to the relationship between the User (Buyer) and the Seller.12.2 In case of questions and complaints from the User (Buyer), he must contact the Seller by phone or in another accessible way. The parties will try to resolve all arising disputes through negotiations, in the event of failure to reach an agreement, the dispute will be referred to a judicial body for consideration in accordance with the current legislation of Ukraine.
12.3 Court recognition of the invalidity of any provision of this Agreement does not entail the invalidity of other provisions.
USER AGREEMENT TO THIS USER AGREEMENT
If the user does NOT agree with all the above conditions, he will NOT be registered on the Seller's Website at the address https://shibuya.redlux.agency/publichna-oferta, will not have the right to place an order and will NOT be able to use all the services of the said Website.
